This Privacy Policy explains how Memories AI LLC ("Memories AI," "we," "us," or "our") collects, uses, shares, and protects information when you use the Mems mobile application and related services (together, the "Service"). By using Mems, you agree to the practices described here.

1. A quick summary
- We collect the information you give us (like your account details) and the memories you choose to add (photos, videos, documents).
- We use AI to help organize and find your media. Your personal content is used to provide these features to you — we do not sell your personal information, and we do not use your private memories to train third-party AI models, except as described in Section 4.
- You control who sees your albums. When you invite family members, you're choosing to share with them.
- The business directory lists third-party companies. We don't control them, and interacting with them is subject to their own terms and privacy practices.
- You can access, export, or delete your data. See Section 10.

2. Information we collect
Information you provide directly
- Account information: name, email address, and password (stored in hashed form) when you create an account.
- Profile details: optional information such as a display name or profile photo, and family relationships you choose to add.
- Your content ("Memories"): photos, videos, audio, documents, scanned items, captions, notes, dates, locations you add, and any other material you upload to the Service.
- Album and sharing information: albums you create, the people you invite, and invitation contact details (such as an email address or phone number you enter to invite someone).
- Communications: messages you send to our support team and your responses to surveys or feedback requests.
Information collected automatically
- Usage data: features used, actions taken, and general interaction patterns within the app.
- Device and technical data: device model, operating system version, app version, language settings, general (coarse) location derived from IP address, and unique device or installation identifiers.
- Media metadata: technical metadata attached to files you upload, such as capture date, file type, and — where present and permitted — embedded location (EXIF) data.
- Diagnostics: crash reports and performance data to help us fix problems.
Information from third parties
- If you sign in through a third-party login provider, we receive basic account identifiers from that provider.
- If you make a purchase, Apple or Google processes the payment and shares limited transaction confirmation with us; we do not receive your full payment card details.
We do not require you to provide sensitive personal information. Because you decide what memories to upload, your content may contain sensitive material (for example, images of family members, including children). Please only upload content you have the right to store and share. See Section 8 regarding children.
3. How we use your information
We use information to:
- Provide, operate, and maintain the Service, including storing and displaying your memories.
- Power AI features that organize your media and let you search it by content (for example, finding photos of a particular person, place, or occasion).
- Enable album sharing and family invitations.
- Provide and improve the business directory experience.
- Authenticate you, secure accounts, and prevent fraud, abuse, and unauthorized access.
- Provide customer support and respond to your requests.
- Send service-related communications (such as account, security, and transactional messages) and, where permitted, optional product updates you can opt out of.
- Analyze and improve the Service, develop new features, and fix bugs.
- Comply with legal obligations and enforce our Terms of Service.
Legal bases (for users in the EEA/UK). We process personal data where necessary to perform our contract with you, based on your consent (which you may withdraw), to comply with legal obligations, and for our legitimate interests in operating and improving the Service in ways that do not override your rights.
4. AI features and how your content is processed
Mems uses artificial intelligence and machine-learning systems to analyze the media you upload so we can label, organize, and make it searchable for you. This processing may occur on your device and/or on our secure servers or those of our service providers.
- Your private memories are processed to provide these features to you.
- We do not sell your personal content, and we do not use the private content of your memories to train foundation models offered to third parties.
- We may use aggregated or de-identified data (data that does not reasonably identify you or any individual) to evaluate, improve, and develop our own features and models.
- Some AI processing may rely on third-party AI service providers acting on our behalf under contractual confidentiality and data-protection obligations, and only to deliver the Service. We do not permit these providers to use your content for their own purposes.
AI results are automated and may sometimes be inaccurate or incomplete. AI features are provided to assist you and should not be relied on as the sole record of any fact.
5. How we share information
We share information only as described here:
- With people you choose. When you invite family members or share an album, the content in that album and related details are visible to those people.
- With service providers. We use vendors for cloud hosting and storage, AI processing, analytics, crash reporting, customer support, and communications. They may access information only to perform services for us and are bound by confidentiality and data-protection obligations.
- Business directory. The directory displays third-party businesses. If you contact or transact with a listed business, that interaction is between you and them and is governed by their own policies. We are not responsible for third-party businesses' practices. See our Terms of Service.
- Legal and safety. We may disclose information if required by law, subpoena, or legal process, or where we believe disclosure is necessary to protect the rights, property, or safety of Memories AI, our users, or the public.
- Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising.
6. Your app permissions
Mems asks for certain device permissions so features can work. You can grant or revoke these in your device settings.
- Photos/Media: to let you select and upload memories.
- Camera: to capture new photos or scan items directly in the app (only if you use that feature).
- Notifications: to send you album invites and service updates (optional).
- Location: only if you choose to add a location to a memory; we do not track your location in the background.
Denying a permission may limit related features but does not otherwise prevent you from using the app.
7. Data retention
We keep your information for as long as your account is active or as needed to provide the Service. If you delete specific memories or your account, we delete or de-identify the associated content within a commercially reasonable period, except where we must retain it to comply with legal obligations, resolve disputes, prevent fraud, or enforce our agreements. Backups may persist for a limited time before being overwritten.
8. Children's privacy
Mems is intended for use by adults (see the age requirement in our Terms of Service). The Service is not directed to children under 13 (or the equivalent minimum age in your jurisdiction), and we do not knowingly collect personal information directly from children to create accounts.
Because Mems is a tool for preserving family memories, adult account holders may choose to upload photos, videos, or other content that depict children. When you do so, you are responsible for having the right to store and share that content, and for the privacy of the individuals — including children — shown in it. We treat this content as your private data and process it only to provide the Service to you.

9. Security
We use administrative, technical, and organizational safeguards designed to protect your information, including encryption in transit and at rest, access controls, and monitoring. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please protect your account credentials and notify us promptly of any suspected unauthorized use.
10. Your rights and choices
Depending on where you live, you may have rights to:
- Access the personal information we hold about you.
- Correct inaccurate information.
- Delete your information and account.
- Export / portability — receive a copy of your memories in a portable format.
- Object to or restrict certain processing, and withdraw consent where processing is based on consent.
- Opt out of non-essential communications.

We will verify your request and respond within the time required by applicable law. We will not discriminate against you for exercising your rights.
California residents (CCPA/CPRA): You have the rights described above, including the right to know, delete, correct, and limit use of sensitive personal information, and the right to opt out of "sale" or "sharing." We do not sell or share your personal information as those terms are defined under California law. You may exercise your rights using the contact details above; you may also use an authorized agent.
EEA/UK residents (GDPR): You may lodge a complaint with your local supervisory authority. Where we transfer data internationally, we rely on appropriate safeguards such as Standard Contractual Clauses.
11. International data transfers
We operate in the United States and may process and store information in the United States and other countries where we or our service providers operate. These countries may have data-protection laws different from those in your country. Where required, we use appropriate safeguards for such transfers.
12. Third-party links and services
The Service may contain links to third-party websites or businesses (including the business directory). We are not responsible for the privacy practices or content of those third parties. Review their policies before providing information to them.
13. Changes to this Policy
We may update this Policy from time to time. If we make material changes, we will notify you through the app or by email and update the "Last updated" date above. Your continued use of the Service after an update means you accept the revised Policy.
